InRoll Terms of Service
These Terms of Service ("Terms") are an agreement between you and INROLL LLC, a Washington limited liability company ("InRoll," "we," "us"). They govern your use of the InRoll website, apps, and services (the "Service"). Organizations that use InRoll are also covered by a separate Organization Agreement; if you are signing up as organization staff, both may apply to you.
By creating an account, clicking to accept, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
About the Service. InRoll is in active development, and features may change.
1. Who InRoll is, and who runs your program
InRoll makes software that organizations such as camps, leagues, and event companies (each an "Organization") use to run enrollment and day-to-day operations.
The Organization, not InRoll, runs the program. The Organization sets its own rules, schedules, policies, health and safety practices, pickup rules, and staffing. InRoll provides the software the Organization uses to do those things. When these Terms say something is the Organization's responsibility, it means InRoll is not responsible for it.
2. Who can use InRoll, and in what role
You must be at least 18 years old to create and hold an InRoll account. By creating one, you confirm that you are at least 18, that the information you give us is accurate, and that you have authority to accept these Terms.
You may use InRoll in one or more of these roles:
- Registrant (parent or guardian): you create an account to enroll and manage a child or another participant, or to enroll yourself.
- Adult participant: you are an adult enrolling yourself; you may hold your own account.
- Organization staff: you act on behalf of an Organization.
Children do not create their own accounts. InRoll does not create accounts for children from their own email addresses. A child participates through a parent's or guardian's account, or an adult participant holds their own account.
3. Your authority to act for a child
If you enroll or manage a child or any other person, you confirm that you are that person's parent or legal guardian, or that you are otherwise legally authorized to act for them and to provide their information and consents. You are responsible for the accuracy of the information you provide about any participant.
Family disagreements. Disagreements between a participant's parents or guardians about access, pickup, or information are resolved by the Organization under its own policies, and InRoll follows the Organization's instructions.
4. Account claiming (placeholder accounts)
An Organization may import a roster that includes you or your participant before you have an account. When that happens, InRoll may create a placeholder record so the Organization can prepare. You claim it by following a secure link or a code provided to you.
By claiming an account, you confirm you are the person (or that person's parent or guardian) the record describes, and you accept these Terms. If a placeholder was created for you by mistake, tell us at [email protected]. Unclaimed placeholder records are handled under our data-retention rules (see the Privacy Policy).
5. Your account and its security
Keep your password private and do not share your login. You are responsible for activity under your account. Tell us promptly at [email protected] if you think someone else has used it. Please keep your contact details and participant information current, because Organizations rely on them for safety decisions such as pickup and medical care.
6. Content you provide, and the limited permission you give us
"Your Content" means the information, photos, documents, and other material you add, including participant profiles and anything you upload.
You keep ownership of Your Content. So that InRoll can operate the Service for your Organization, you give InRoll a limited, non-exclusive permission to host, store, process, display, and transmit Your Content only to provide and support the Service for you and your Organization.
This permission is narrow on purpose. InRoll does not sell Your Content and does not take any right to a participant's name, image, likeness, or voice for marketing or monetization. The permission lasts only as long as needed to provide the Service and ends when Your Content is deleted under our retention rules, except for backups kept briefly and anything we must keep by law.
You are responsible for having the right to provide Your Content, including the right to upload a photo that shows another person or another person's child.
7. Photos
Organizations may capture and upload photos (for example activity photos and check-in or check-out photos) and may make galleries available to authorized families. Who can see which photos is controlled by the Organization's settings. If you do not want a participant to appear in Organization photos, raise it with the Organization, which controls its photo program.
8. Face matching (optional, opt-in, and revocable)
For photo galleries, an Organization may enable an optional face-matching feature that helps identify a participant across activity photos.
Face matching never runs for a participant without an opt-in. Consent is a separate, clear, affirmative step, given for each participant by the person with authority (the parent or guardian, or the adult participant). It is not given by accepting these Terms or the Privacy Policy. Consent may be given in your account, in person to Organization staff who record it, or in writing through the Organization's own enrollment paperwork, recorded on the participant's profile.
InRoll stores face templates only for participants who have opted in. Photos are scanned to locate opted-in participants; no face template is created or kept for anyone else.
You can withdraw consent at any time. When you withdraw, InRoll stops face matching for that participant and promptly deletes that participant's face templates. Face data does not outlive the data it relates to: when the feature is turned off, or when a photo, account, or Organization is deleted, associated face data is deleted in accordance with the retention and deletion rules described in the Privacy Policy.
Face matching is assistive only. Matches may be incorrect or missed, and no level of accuracy is guaranteed. Face matching is used to help organize and find photos. It is never used for identity verification, check-in, or pickup authorization. Verifying the identity of a participant and of any pick-up person is the Organization's responsibility. To the fullest extent the law allows, InRoll is not liable for incorrect, missed, or spurious matches.
Biometric data is never sold. Participant photos, face templates, and photo tags are used for no purpose other than operating the photo and face-matching features. See the Privacy Policy and our Consumer Health Data Privacy Policy for more detail.
9. Health and medical information
Some programs collect health or medical information so staff can care for participants safely (for example allergies, medications, conditions, insurance, and emergency contacts).
InRoll is a software provider, not a medical or healthcare provider. InRoll does not give medical advice, does not provide medical care, and does not verify the accuracy of health information. If you provide health information, please make sure it is accurate and current; people may rely on it in an emergency. Health information is treated as sensitive: access is limited by staff role, it is protected in transit and at rest, and it is never used for advertising or sold. In a medical emergency, call your local emergency number; do not rely on the Service to summon help.
10. Payments and fees
When you pay for a program, add-on, or booking through the Service, you are buying from the Organization, not from InRoll. The Organization is the seller and merchant of record, sets its prices and its cancellation and refund policy, and is responsible for what it provides. Card and bank payments, when used, are handled by our payment processor under its own terms. InRoll is not responsible for an Organization's prices, services, cancellations, refunds, or disputes; for a refund or billing question, contact the Organization.
If InRoll offers any feature to you for a fee, the fee will be stated before you commit to pay. InRoll may introduce or change its fees with reasonable advance notice.
11. Acceptable use
You agree to use the Service lawfully and to not:
- upload or manage information about a person or child you are not authorized to manage;
- provide false, misleading, or someone else's identity information;
- upload unlawful, harmful, harassing, or infringing content;
- attempt to access data, accounts, or Organizations you are not authorized to access, or defeat the Service's security or permission controls;
- use the Service to send spam or to scrape or harvest others' data;
- interfere with or disrupt the Service, or use it to build a competing product.
You are responsible for the accuracy of safety-critical information you enter, including pickup authorizations and any list of people who are not permitted to pick up a participant.
12. Third-party services
InRoll relies on trusted third parties to run the Service, including cloud hosting, storage, and email delivery. InRoll is not responsible for third-party services outside our control, or for websites we link to.
13. Privacy
Our Privacy Policy explains what information we handle and how, and it is part of these Terms. Our Consumer Health Data Privacy Policy, linked from our homepage and in the app, describes how health-related information, including face templates, is collected, used, and shared, and how to exercise your rights.
14. Changes to these Terms
We may update these Terms as the Service evolves. If we make a meaningful change, we will let you know, for example by email or a notice in the Service, and, where appropriate, we will ask you to accept the updated Terms before you keep using the Service. Material changes to Section 19 (Disputes) take effect only after notice and your renewed acceptance.
15. Suspension, termination, and what happens to data
You may stop using InRoll at any time and may ask us to close your account. We may suspend or end access if these Terms are broken, if required by law, or if we must do so to protect people or the Service.
If your account or an Organization's account is closed, data is handled under the retention rules in the Privacy Policy: InRoll uses a soft-delete window (currently 60 days) before permanent deletion, and Organizations may be purged at their request. Some records may be kept longer where the Organization or InRoll must keep them by law. Requests to change or delete a participant's Organization data must be made to the Organization directly: InRoll manages only the information it holds for your own account, and InRoll is not an intermediary for requests to an Organization. The Organization's own legal retention duties may apply to its records.
16. Disclaimers
The Service is provided "as is" and "as available." InRoll does not promise the Service will be uninterrupted, error-free, or that it will meet every need. The Service depends on multiple third-party cloud and communications providers, and downtime can result from provider outages, internet connectivity problems, carrier and communication failures, and similar causes outside InRoll's control; InRoll uses commercially reasonable efforts to keep the Service functioning but does not guarantee availability, and, to the fullest extent the law allows, is not liable for the impacts of such downtime (see Section 17). InRoll uses commercially reasonable administrative and technical safeguards to protect information (see the Privacy Policy's security section), but no security measures are guaranteed to be effective, and InRoll does not warrant that information, including health information, will be immune from unauthorized access. InRoll is not responsible for the acts, omissions, programs, safety practices, or content of any Organization or other user. InRoll does not verify the accuracy of information Organizations or other users enter, and what the Service displays and computes depends on that information; InRoll does not warrant that displayed or computed information (including rosters, schedules, balances, and health information) is accurate, complete, or current. To the fullest extent the law allows, InRoll disclaims all warranties not expressly stated here, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
17. Limitation of liability
In plain language: InRoll's responsibility to you for problems with the Service is limited, and its total liability is capped at US$100.
To the fullest extent the law allows: InRoll is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, revenue, goodwill, or opportunities. InRoll is also not liable for any losses or damages arising from unavailability, downtime, outages, interruptions, data loss, or failure to process or store data; from inaccurate, incomplete, or out-of-date information displayed or computed by the Service, or reliance on it; from messages not delivered (including email, text, and app notifications); from payment processing, including processor unavailability and declined, failed, delayed, or misrecorded charges, payouts, or refunds; or from unauthorized access to, or unauthorized acquisition, use, or disclosure of, information (including health information) resulting from a compromise of security; in each case regardless of cause, including third-party provider failures, internet or communications failures, and InRoll's own acts, omissions, errors, and accidents, including ordinary negligence. This exclusion does not apply to InRoll's gross negligence or willful misconduct. InRoll's total liability arising out of the Service is capped at US$100. Nothing in these Terms limits liability that cannot be limited by law.
18. Indemnification
You agree to cover InRoll's losses and reasonable costs arising from claims caused by your misuse of the Service, Your Content, your breach of these Terms, or your violation of law or another person's rights, including a claim that you lacked authority to provide a participant's information or consents. This does not apply to the extent a claim arises from InRoll's own fault.
19. Disputes and governing law
Unless explicitly stated otherwise, these Terms and any dispute arising out of the Service are governed by the laws of the State of Washington. Disputes are resolved in the state or federal courts located in King County, Washington, and you and InRoll consent to that venue.
InRoll expects that it may adopt arbitration for disputes in the future. Any such change will be made by updating these Terms and will take effect only after notice and your renewed acceptance, as Section 14 describes.
Regardless of forum, disputes about the program itself (schedules, care, conduct, prices, and refunds) are between you and the Organization, not InRoll.
20. General
These Terms and the Privacy Policy (including the Consumer Health Data Privacy Policy) are the entire agreement between you and InRoll about the Service. If you act on behalf of an Organization, the Organization Agreement governs the business relationship between InRoll and the Organization, these Terms govern your own use of the Service, and in a direct conflict about the Organization relationship the Organization Agreement controls. If a part is unenforceable, the rest stays in effect. Our not enforcing a term is not a waiver. Sections that by their nature should continue (including Sections 6, 16, 17, 18, and 19) survive the end of these Terms. You may not assign these Terms; InRoll may assign them to an affiliate or successor.
